1 THIS WEBSITE
1.1 This website is owned and operated by Wild Roses Glass. If you choose to order any products from us, we, Wild Roses Glass will be the contracting party. The terms and conditions set out below will govern your use of the Wild Roses Glass websites and any transactions entered into between you and us. Accordingly, you should read them carefully and ensure you understand and agree to them before placing your order. By using this website and/or placing an order you agree to be bound by these terms and conditions.
1.2 The content of the pages of this website is for your general information and use only. It is subject to change without notice.
1.3 We may change these terms and conditions from time to time and you should therefore check them whenever you place an order.
1.4 These terms and conditions shall not affect your statutory rights.
2 PLACING ORDERS
2.1 All orders placed by you are subject to acceptance by Wild Roses Glass. Acceptance of your order by us will take place when we dispatch your order to you.
2.2 When you place an order on our website we will email you acknowledgement of your order and debit your Paypal account unless we agree in our absolute discretion to accept an alternative payment method. This will not, however, constitute acceptance of your order by us. We may choose not to accept your order for any reason without liability. If you wish you can pay by cheque if you arrange it with us, by contacting us by phone.
2.4 Prices may change without notice. If for any reason an incorrect price has been quoted on any order placed we will contact you by email or phone and offer you the opportunity to pay the difference. If you decide to decline a full refund will be made and the order cancelled.
3.1 Goods will be delivered to you by the method selected and to the address provided by you when you place the order.
3.2 When an order is received, we will take all reasonable steps to deliver them within the quoted timescale, but do not guarantee to do so. We shall not be liable to you for any loss or damage whether arising directly or indirectly from the late delivery or short delivery of the Goods.
3.3 Any arrangement made by you with the carrier to deliver goods into the property address will be at your risk and we will not be responsible for any damage done to the goods or to the property, or to yourself, or any one else as a result of such an arrangement.
3.4 All goods must be signed for by an adult aged 18 years or over on delivery unless delivered by Royal Mail. If you fail to take delivery of the Goods within a specified timescale, we shall be entitled to charge you the reasonable costs of re-delivery. Delays around Christmas and Bank Holidays are normal. However, we will try to ensure that you receive your order as quickly as possible.
3.5 Acceptance of the Goods You shall be deemed to have accepted the Goods 48 hours after delivery. You shall carry out a thorough inspection of the Goods within 48 hours of delivery and shall give written notification to us within 5 days of delivery of the Goods of any defects, which a reasonable examination would have revealed. Where you have accepted, or have been deemed to have accepted, the Goods, you shall not be entitled to reject the Goods except as provided by this Contract.
4 CANCELLATIONS AND RETURNS
4.1 You may cancel your order for any item purchased on this website and receive a full refund (excluding costs in respect of postage and packaging). To do so, you must:
4.2 advise us by email or post within seven working days of delivery of your item(s), quoting your order number.
4.3 Take reasonable care of the item(s); leaving all item(s) intact. The item(s) should be returned in the original packaging. The product should be unused and in perfect condition.
4.4 Return the item(s) to us as soon as possible but no longer than 14 days from the date of delivery. Goods, which are returned to us outside of 14 days, will be charged a restocking fee of 30% of the cost of the item with a minimum fee of £10. When returning an item, please include the reason for return. Please ensure you obtain a Certificate of Mailing from the Post Office. Wild Roses Glass, does not accept responsibility for the loss of packages sent back to us by a customer; therefore, we encourage you to return your items using recorded delivery. Proof of postage and recorded delivery receipts need to be retained by the customer. You will be responsible for the cost of returning the item(s) to us unless the items are faulty.
4.5 Goods damaged when being returned will not be refunded and we therefore strongly recommend that items be insured when returned.
4.6 The goods must be sent back at your cost and arrive at our premise without damage and in a condition which we can resell the goods.
4.7 Certain products are not covered by our returns policy. These include any commissioned or made to order products.
4.8 Your statutory rights or those regulated by the Consumer Protection (Distance Selling) Regulations 2000 are not affected.
4.9 Please allow 30 days from receipt by us of your item for your refund to be processed. We will normally refund using the same payment method used to purchase the goods.
5 DAMAGED OR FAULTY GOODS
5.1 We employ professional carriers. Nevertheless, items must be examined on arrival before being signed for.
5.2 If a product is found to be damaged or faulty on delivery please contact us at once and no later than 24 hours. We ask that you photograph the wrapping and damaged item in order for us to proceed with any insurance claim.
5.3 In the first instance we will offer you a suitable replacement if available. If you decide not to accept we will arrange for a refund of the full purchase price including postage and packing.
5.3 Goods must be returned as per our returns policy in 4 above.
5.4We reserve the right to refuse to issue a refund or replacement item and to recover the cost of the returns delivery from you in the event that the item is found to have suffered damage after delivery or has been misused or if the problem is due to normal wear and tear.
5.5 Please allow 30 days from receipt by us of your item for your refund to be processed or replacement item to be dispatched.
6.1 All rights, including copyright, in this website are owned by or licensed to us. You may not copy the website or any part of it or use it for any purpose other than for the consideration of and purchase of our products.
6.2 We will use reasonable endeavour’s to detect and destroy any viruses and other forms of malicious software but will not be liable for any damage to any computer arising as a result of such viruses or other malicious software.
6.3 You will be solely responsible for ensuring the security of any of your passwords.
6.4 Except as provided below the total liability of Wild Roses Glass arising in contract, tort or otherwise shall not exceed the value of the order to which such liability relates or £100 whichever is the greater.
6.5 These exclusions of liability shall not apply to any damages arising from death or personal injury caused by our negligence.
6.6 Each of these terms and conditions shall be construed separately and independently of the others and the validity of any one term or condition shall not affect the validity of any other.
6.7 All warranties, conditions and other terms implied by applicable law are excluded to the fullest extent permitted by law.
6.8 Neither you nor we shall be responsible for delays or failure to perform any of our obligations herein (other than payment obligations) resulting from acts beyond our reasonable control. Such acts shall include, but shall not be limited to, acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, communication line failures, power failure, earthquakes or other disasters.
6.9 These terms and conditions will be governed by the laws of England and you and we agree to submit to the non-exclusive jurisdiction of the English courts.
